If you received a 2-year conditional green card through marriage, you’ll need to file Form I-751, Petition to Remove Conditions on Residence to keep your lawful permanent resident status.

What Is the I-751 Petition?

When you’re granted a green card based on a recent marriage (less than 2 years old at the time of approval), USCIS gives you conditional permanent residence. That status expires after 2 years unless you file Form I-751 to remove the conditions and obtain a 10-year green card.

This process proves to the government that your marriage is real and ongoing, and not just for immigration purposes.

When to File

You must file the I-751:

  • Within the 90 days before your 2-year green card expires.

  • Filing too early or too late can cause serious problems, including the risk of losing your green card.

Filing Jointly vs. Filing with a Waiver

  • Joint Petition: Most couples file together. You’ll submit the form along with documentation showing your marriage is genuine and still ongoing.

  • Waiver Petitions: If you’re no longer married or your spouse is abusive, you may still be eligible for a waiver to file on your own. Common waiver reasons include:

    • Divorce or annulment (if marriage was in good faith)

    • Abuse or battery by your U.S. citizen or LPR spouse

    • Extreme hardship if removed from the U.S.

Evidence to Include

Some common evidence to prove your legitimate relationship can include:

  • Joint bank account or credit card statements

  • Lease or mortgage documents with both names

  • Utility bills in both names

  • Birth certificates of children born during the marriage

  • Photos together over time

A well-prepared petition can avoid delays or requests for evidence (RFE).
